I work for a translation company, and we have an odd situation. I wonder if anyone can help?
We have been working in a franchise-type situation with another company, whereby they provide sales/marketing services, ie providing the services of sales people who get business, and they pass all the work to us, in return for which we pay them a commission.
We have created TMs for several of our joint clients, but none of these clients (nor our partners) have ever paid a fee for creating and maintaining these TMs. Our partners have a copy of the TMs (for info only!!)Our contract is about to expire and does not cover what happens to the intellectual property after termination (eg the knowledge of the client base and the TMs).
Does anyone know if we can prevent them from using the TMs that we created if they should start up a new, similar arrangement with another translation company?
Ideas and thoughts would be much appreciated!!
